PowerPump LLC (“PowerPump,” “we,” “our,” or “us”) provides this privacy policy (the “Policy”) to inform you on how we process your information, whether you are a visitor and or customer (“you,” “your”) to our website, a purchaser of our EV charging stations, or a user of EV charging stations on the PowerPump Network. “PowerPump Network” refers to PowerPump’s open-platform network of EV charging stations and vehicle charging applications.

Except as explicitly provided herein, this Policy applies to your use of the PowerPump website (the “Website”), the PowerPump mobile application (the “App”), and to any service offered by PowerPump that includes a link to this Policy, including your PowerPump account (if you have registered or are registering your account) and the PowerPump radio-frequency id cards (the “RFID cards”) (each of these services and applications are collectively defined as the “Service”).

For California residents, “Personal Information” shall have the definition as set forth in the California Consumer Privacy Act (“CCPA”). Please see the section below entitled “California Consumer Privacy Notice” for more information.

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your Device’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We may also collect information that your browser sends whenever you visit our service or when you access the Service by or through a mobile device.We collect this data from you, your use of our services, our affiliates, and third parties (such as agents/service providers). We may share this information with third parties or affiliates when we deem it proper.

The time periods for which we retain your Personal Information depend on the purposes for which we use it. We will keep your Personal Information for as long as your user account is active, or as long as you are a customer or user of our Services or for as long as we have another business purpose to do so (such as, but not limited to, for business, tax, or legal purposes) and, thereafter, for no longer than is required or permitted by law, or our records retention policy, reasonably necessary for internal reporting and reconciliation purposes, or to provide you with feedback or information you might request. This period of retention is subject to our review and alteration.

Following termination or deactivation of your user account, we may retain your profile information and all information posted to public areas of the Website. Following termination or deactivation of your user account, we may retain your Personal Information and other data, but will maintain it as confidential according to the Terms, this Privacy Policy, and as required by applicable law. We have the right to delete all of your Personal Information and other data after termination of your user account without notice to you. We may retain De-Identified Personal Information for as long as we deem appropriate.

Information that you provide by filling in forms on our Website or Mobile App. This includes information provided at the time of registering to use our Website or Mobile App, subscribing to or purchasing our Services, e-newsletters, posting material (where permitted), or requesting further Services. Records and copies of your correspondence (including email addresses) if you contact us.

Your responses to surveys that we might ask you to complete for research purposes.

Information We Collect Through Automatic Data Collection Technologies. As you navigate through and interact with our Website and Mobile App, we may use automatic data collection technologies to collect certain aggregated or anonymized information about your equipment, browsing actions and patterns, including:

Details of your visits to our Website, including, but not limited to, traffic data, geolocation data, logs, and other communication data and the resources that you access and use on the Website.

Information about your computer and internet connection, including your IP address, operating system, browser type, clickstream patterns, the URL of the most recent website you visited before coming to our Website, the amount of time you spent on our Website, and the pages you viewed while on our Website. Your location while using the Mobile App.

We do not allow personalized third-party behavioral tracking, though we may use De-Identified Personal Information to track users’ click or browsing patterns.

The information we collect automatically is statistical data and may include Personal Information, but we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Website or Mobile App and to deliver a better and more personalized service.

You may modify certain of the information we maintain about you by accessing your account. You may unsubscribe from marketing communications from us by following the directions in those communications. Please note that where you opt out of, and unsubscribe from, receiving marketing communications, we may still send you certain communications relating to your use of the Service (e.g., service announcements, notices about new features or information on the Service, administrative messages, and communications regarding your account).

Tracking Technologies and Cookies

Like most websites, PowerPump uses cookies and similar technologies, including web beacons, embedded scripts, and e-tags (together referred to as “cookies,” unless otherwise stated) to provide users an efficient user experience in using the Website. A cookie is a small data file placed on your computer or mobile device by your web browser. It is a tool that stores information about website visits, recognizes you and your preferences each time you visit the Website, optimizes website functionality, and enables us to provide the Service. Some parts of the Website use cookies to track user traffic patterns.

We also use cookies to implement tracking technology on our Website and Mobile App. This allows us to display advertising that is tailored to you on our Website which parts of our content interest you the most and which Service categories you request. This tracking uses De-Identified Personal Information data. We will not combine this data with your other Personal Information without your express permission. Some of our contracted vendors and affinity partners are allowed to place cookies on our Website. Those companies may also provide you with the option of preventing the use of cookies in the future. At any time, you can prevent the use of cookies in the future. You may activate the appropriate setting in your browser to refuse to accept browser cookies. However, if you do, your experience on our Website may be affected.

How we share your information

We do not sell (as that term is defined in the CCPA) Your personal information.

With our service providers and other contractors (e.g., hosting and financial providers, marketing, customer support platforms, and data storage providers); With our affiliates; With our distributors, resellers, channel partners, PowerPump station owners, or authorized third parties including third-party network providers, utilities or their respective employees, freelancers, and consultants to help us provide our Service to you; With Site Hosts when you connect with a PowerPump station operated by a Site Host; At your direction or with your consent, such as when you use our social media features to provide information to PowerPump users about our Service or when you direct us to share information with third parties such as utility companies; In connection with the negotiation, diligence, or actual merger, acquisition or any form of sale of some or all of PowerPump assets or business; In the unlikely event of insolvency, bankruptcy or receivership in which your information would be transferred as one of PowerPump’s business assets;
Where we are legally obligated to disclose information to the government or third parties for the purposes of criminal or fraud investigations, national security, law enforcement or other issues of public importance; and Where we otherwise believe it appropriate to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms and Conditions or any other legal terms governing use of the Service, and/or to protect our rights and property and the rights and property of other users.

How we use your information

We use information that we collect about you or that you provide to us, including any Personal Information, for one or more of the following purposes:

  • To present our Mobile App and its contents to you.
  • To provide you with the Services that you have requested.
  • To provide you with information on products or Services that you request from us.
  • To provide you with notices about your account, including expiration and renewal notices.
  • To send you emails, text, and newsletters with information on products, services, discounts, special promotions or upcoming events, and features or offers that we believe will be of interest to you, our company, and other information.

  • To contact you with regard to the Website or Mobile App and to send important notices, such as communications about our Services, your account or changes to our terms, conditions, and policies.

  • To process other information or Personal Information that you submit through this Website or Mobile App.
  • To notify you about changes to our Website, Mobile App, our policies, terms, or any products or Services we offer or provide though it.

  • To ask for ratings and reviews of our Website, Mobile App, Services, and/or products.

  • To provide access to restricted parts of our Website or Mobile App.
  • To request your participation in surveys, or other initiatives which help us to gather information used to develop and enhance our products and Services.

For examination or event registration, scheduling, attendance verification, administration, and related purposes.

  • To serve relevant information to you when you visit our Website, Mobile App, or other third-party sites (including social media platforms).
  • To enhance and improve our products and Services, for example, by performing internal research, analyzing user trends, and measuring demographics and interests.
  • To improve our content and deliver information to you that is targeted to your interests.

For internal purposes, such as Website, Mobile App, and system administration or internal audits and reviews.

  • For analyzing how any of the Services are used, diagnosing Service or technical problems, maintaining security, and personalizing content.
  • To operate, maintain, and provide you with the features and functionality of the Services.
  • To provide statistics about the usage of the Website or Mobile App and other related information to reputable third parties, but these statistics will not include information which will allow you to be identified.

  • To provide marketing material or advertisements from PowerPump or its partners to you, but you will be able to opt-out of these communications.

We use historical Charging Session data to (1) forecast network utilization; (2) evaluate and understand trends across the charging network; (3) establish charger capacity needs by geography; (4) conduct financial analyses; (5) determine pricing and reimbursements; (6) create and assign customer profiles; and/or, (7) build promotion and advertising campaigns internally and jointly with promotional program Service Providers.

We may use your Personal Information you provide us and which we obtain from other sources to better understand your interests so we can try to predict what other products, Services, and information you might be most interested in. This practice involves making automated decisions about you based on this information in order to better enable us to tailor our interactions with you to make them more relevant and interesting.

Data Transfer/Access outside of the United States

We have our headquarters in the United States. The Personal Information we or our service providers collect may be stored and processed in servers within or outside of the United States and wherever we and our service providers have facilities around the globe, and certain information may be accessible by persons or companies outside of the United States who provide services for us. As such, we and our service providers may transfer your Personal Information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction.

Information We collect from Third Parties

Analytics. We may use third-party analytics services such as Google Analytics. These service providers use the technologies described in the “Information We Collect Automatically” section above to help us analyze how users use the Service, including analyzing your Website use, compiling reports on Website activity, and providing us with other services relating to Website activity and internet usage. We may also use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your analytics information, you may install the Google Analytics Opt Out Browser Add-on for your current web browser.

Advertising. We and our third-party service providers may use device identifiers and other automated technologies (including cookie identifiers on our Website), along with other collected information, to deliver content or tailor ads when you are on our Service or other devices, apps, or websites. These ads may be based, for instance, on the types of websites that you visit over time, the types of apps you have on your device, or de-identified information about you and your interests, based on your activities off of our Service. Partners that we or others work with to do the above may track your activities over time (including across different apps or websites) by collecting information through automated means, and they may use this information, and other information they receive from us or other sources, to deliver advertisements to you. You may control and block the cookies used by the Website by modifying the settings in your browser or on your device that allow you to refuse the setting of all or some cookies. You can also adjust your settings so that your browser blocks all cookies or only cookies from third parties. You can also delete cookies that have already been placed. However, please note that if you use your browser or device settings to block all cookies, you may not be able to access all or parts of our Website.

This Website may contain links to third-party sites. Access to any other websites linked to the PowerPump Website is at the user’s own risk, and PowerPump is not responsible for the accuracy or reliability of any information, data, opinions, advice, or statements made on these websites. PowerPump provides these links merely as a convenience and the inclusion of such links does not imply any kind of endorsement. If you provide any third party with your information, we recommend that you review their privacy policies as PowerPump does not control how they collect, process, and transfer your information.

Data Security

PowerPump has implemented administrative, physical, and technical security measures to protect your information under our control.

While PowerPump takes precautions against security breaches of its Website and Service, no website or Internet transmission is completely secure, and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We cannot guarantee the security of your information while it is being transmitted to our Website or stored in our systems, and any transmission is at your own risk.

You should take steps to keep your information safe (including your password) and log out of your account after use. Where we have provided you, or you have chosen, a password that enables you to access certain parts of our Website, or a PowerPump RFID Card to access charging stations, you are responsible for keeping your password and PowerPump RFID Card confidential. You must not share these with anyone or store them in a way that may allow a third party to access them. If that happens, you agree to report it immediately to privacy@PowerPumpCharging.com. PowerPump cannot be held responsible for your failure to keep your password or PowerPump RFID Card secure.

You should update your password periodically to help reduce the risk of unauthorized access to your account with us. When you do, you should strengthen your password with the combination of uppercase and lowercase letters, numbers, punctuation, and other symbols.

Children’s Privacy

The Website and Service are intended for persons licensed to drive. In the United States, this typically means individuals over the age of sixteen. PowerPump does not knowingly collect any information from anyone under 16 years of age. If you are less than 16 years of age, we request that you do not submit information to us. If we become aware that we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of thirteen without parental consent, we will take reasonable steps to delete it as soon as possible as required by applicable law.

California Consumer Privacy Notice

Supplemental Privacy Notice for California Residents:

This Supplemental Privacy Notice supplements the information in our Privacy Policy, and except as provided herein, applies solely to California residents. It applies to personal information we collect on or through the Service and other means (such as information collected offline, in person, and over the telephone). It does not apply to personal information we collect from our employees and job applicants in their capacity as employees and job applicants. It also does not apply to personal information we collect from employees, owners, directors, officers, or contractors of businesses in the course of our provision or receipt of business-related services.

Rights

If you are a California resident, you may have certain rights. California law may permit you to request that we:

Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information. Provide access to and/or a copy of certain information we hold about you. Delete certain information we have about you.

You may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right not to be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Service to you. If you ask us to delete it, you may no longer be able to access or use the Service.

If you would like to exercise any of these rights, please submit a request to support@PowerPump.io. You will be required to verify your identity before we fulfill your request. To do so, you will need to provide the information identified in the webform or as otherwise directed by us. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization, or a power of attorney signed by you for the agent to act on your behalf. You will still need to verify your identity directly with us.

California residents may opt out of the “sale” of their personal information. PowerPump does not “sell” your personal information as we understand that term to be defined by the California Consumer Privacy Act and its implementing regulations, and we have not sold your personal information in the past twelve months.

California Do-Not-Track

We do not respond to browser initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.

GDPR Jurisdictional Data Protection Rights

If you live in a region that is subject to the GDPR, the Company would like to inform you that you have the following data protection rights:

The right to access – You have the right to request copies of your personal data from us at no charge.

The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete information you believe is incomplete.

We reserve the right to make changes to this Privacy Policy. Our current Privacy Policy will always be on our Website and any updates will be effective upon posting. You are responsible for periodically checking this Website for updates. Certain areas of our Website or our Mobile App may require you to acknowledge your consent via a pop-up message and/or click-through box requiring your agreement to the amended Privacy Policy before you can proceed to that Website area or to use the Mobile App. For any significant change affecting your Personal Information (defined below), we may notify you of such change. If you disagree with any change, you must stop using our Services; otherwise, we will consider your continued use to be acceptance of any change.
